Απολαύστε την πραγματική, υποθέτουμε, συμφωνία Κοινότητας - Αρχιεπισκοπής.!!!

 

Δημοσιεύουμε σήμερα, την …περιβόητη συμφωνία-έκτρωμα την οποία υπογράψαν (;) Ελληνική Κοινοτητα και Αρχιεπισκοπή, ύστερα από διαβουλεύσεις που έγιναν μεταξύ αρχιεπίσκοπου Σωτήριου και του …Σωτήρη Αθανασούλα, παρουσία του γιατρού Μαυραντώνη, ως εκπροσώπου της επιτροπής την οποία σχημάτισε ο ίδιος, κατά πως λένε οι …κακές γλώσσες.!

Η παρακάτω συμφωνία, έφτασε στα χέρια μας από πολύ παλιό στέλεχος της Κοινότητας (της εποχής Πολυμενάκου) και φαίνεται να είναι η πραγματική, -παρ’ όλες τις λίγες μικρές επιφυλάξεις που έχουμε- και ως εκ τούτου σας την μεταφέρουμε, δίνοντας, ελπίζουμε, τέλος (;) στα διάφορα αμφιλεγόμενα σχόλια που κυκλοφορουν, μήνες τώρα, με τους ¨κατασκευαστές της¨ να αδιαφορούν γράφοντας τους ομογενείς της παροικίας στα παλαιότερα των υποδημάτων τους.!

Φυσικά, διαβάζοντας το περιεχόμενο της «συμφωνίας» αντιλαμβάνεται κανείς γιατί οι υπεύθυνοι των δυο οργανισμών αποφεύγουν την δημοσιοποίησή της, επί αρκετές εβδομάδες τώρα, κάτι όμως που θα σχολιάσουμε εν καιρώ και συγχρόνως με τα δικά σας σχόλια. Απολαύστε, λοιπόν, το περιεχόμενο το οποιο ελπίζουμε να μην είναι …μαϊμού και βλέπουμε:

 MINUTES OF SETTLEMENT 

WHEREAS Father Peter Avgeropoulos, Father Philip Philippou, Father Konstantinos Pavlidis and Father Spyridon Vitouladitis (the "Priests") commenced an action against the Greek Community of Toronto (the "GCT") and George Alikakis, Adonis Artemakis, Athansios Broumas, Sam Castrinos, Anastasios Chatzitheofanou, Anastais Gannogiannis-Reid, Nikona Georgakopoulos, Argirious Haros, Martha Henty, Hermes Iordanous, Dionisios Kosmatos, Dimitrios Milaris, Manolis Mylonakis, George Nikolaou, Semela Setedis, Peter Themeliopoulos, Zsis Vokas, John Bozios and Peter Apostolopoulos (collectively the "GCT Directors") by Statement of Claim dated August 5, 2015 bearing Court File No. CV-15-533769 (the "Priests' Action"); 

AND WHEREAS the GCT commenced a subsequent action against the Priests, the Greek Orthodox Archdiocese of Canada (the "Archdiocese"), Archbishop Sotirios Athanassoulas (the "Archbishop") and George Philippou, Maggie Philippou-Infantino, Ioanna Philippou (collectively the "Philippou Family") and Vasiliki Tsiolis, Chaido Christoforidis, Vasiliki Karsaki, Aphroditi Sklavos, Maria Diakoloukas, Athina Plassaras, Athanasia Giannakopoulos, and Mary Manoukas (collectively, the "Ladies") (collectively the "Defendants") by Statement of Claim dated October 17, 2018 bearing Court File No. CV-17-584750 (the "GCT Action"); 

AND WHEREAS the Defendants commenced a counterclaim against the GCT in the GCT Action (the "Defendants' Counterclaim"); 

AND WHEREAS the Parties wish to settle the claims made in the Priests Action, the GCT Action and the Defendants' Counterclaim (collectively the "Proceedings"), as well as any and all claims and counterclaims that could have been made in the Proceedings; 

NOW THEREFORE IN SETTLEMENT of the Proceedings, the Parties agree as follows:

1. In full and final satisfaction of the claims raised in the Priests’ Action and in the GCT Action, the GCT will pay to each of Fathers, Pavlidis, Vitouladitis, Philippou and Avgeropoulos calculated as of November 1, 2021 on the following basis: 

a. $410,000 to Father Vitouladitis; 

b. $405,250 to Father Phillippou;

c. $389,046 to Father Pavlidis (CERB confirmation to be provided); and, d. $90,250 to Father Avgeropoulos.\ 

2. The Priests’ settlement funds set out in paragraph 1 above shall be paid to “Clyde & Co, in Trust”, in their entirety by certified cheque or by Electronic Funds Transfer (“EFT”). Each of the Priests shall be responsible for paying any income taxes and statutory deductions on the settlement funds set out in paragraph 1, if any. 

3. Payment of the funds to the Priests as set out in paragraph 1 shall be paid by the GCT in two (2) installments: 50% of the settlement funds to be paid within 30 days of the date of the execution of these Minutes of Settlement; and, 50% of the settlement funds to be paid by May 1, 2022. 

4. Thereafter the Parties hereto agree and recognize that priests serving the GCT Churches shall always be appointed by the Archdiocese under the jurisdiction of the Ecumenical Patriarchate. The Parties further agree that the Priests shall be compensated by the GCT in accordance with the remuneration guidelines as established by the UCR, from time to time, for the base pay of the Priests which is presently set at $62,000.00 plus $1,000.00 to be added for each year of service to a maximum annual compensation of $72,000.00 to the full-time Priests, inclusive of pension contributions and health plan contributions, beyond which, they shall be entitled to reimbursement from the GCT for their reasonable expenses, with receipts, for attending the annual Clergymen’s Retreat and the Biennial Clergy Laity Assembly. 

5. Pronia will be renamed the “Philoptochos – Pronia” and two representatives of each of the four chapters operating at the GCT Churches will participate in the biennial general assemblies of the Archdiocesan Philoptochos. Each chapter of the Philoptochos-Pronia will pay an annual fee equal to three and half percent (3.5%) of its total gross annual income to the Archdiocesan Philoptochos Council for the first five (5) years following the execution of these Minutes. Thereafter, that number percentage will be increased to seven percent (7%) or to a percentage that is determined by a decision made on such payments by the Philoptochos Chapters across Canada at the Biennial Conference of the Philoptochos Society of Canada. 

6. All of the money collected by the Archdiocese as a result of the Sacramental Fees imposed on the GCT Churches through to the present will be retained by the Archdiocese in full satisfaction of any prior Annual Contributions owed by the GCT to the Archdiocese through to the date of execution of these Minutes. 

7. Following execution of these Minutes of Settlement, the GCT will always pay to the Archdiocese annual fees as established by the UCR and the decisions of the 2 biennial Clergy-Laity Assemblies. Presently, this fee is $160,000 per year (being $40,000 per Church per year). 

8. On execution of the Minutes of Settlement and following the receipt of the first monthly instalment of the Annual Contributions, the Archdiocese will no longer require the payment of a Sacramental Fee for any baptism, funeral, or wedding to be performed at any of the GCT Churches. So long as the GCT remains compliant with its obligations to pay its Annual Contributions on a monthly basis as set out in paragraph 6 of these Minutes, the Archdiocese will refrain from reimposing any Sacramental Fees for sacrament performed at the GCT Churches. 

9. The Parties shall exchange full and final mutual releases releasing and any all claims relating to the matters raised, or which could have been raised, in the Priests’ Action, the GCT Action and the Defendants’ Counterclaim. The form of release will be agreed upon by counsel to the Parties, acting reasonably, and completed no later than December 1, 2021. 

 10.Following the execution of the Minutes of Settlement, the execution and exchange of releases set out in paragraph 9, and the completion of the payments set out in paragraph 1-3 of these Minutes, the Parties to the litigation will agree to a dismissal of the Priests’ Action, the GCT Action and the Defendants’ Counterclaim on a without costs basis.
